Protecting privacy is one key cloudHQ design issues: When we designed cloudHQ we had in protecting of your personal as the key design choices – not just review privacy implications after a product or process is developed. We conduct regular data protection impact assessments to meet the privacy by design principle.

User rights: The GDPR clearly defines set of user rights – and these right something we consider very natural and reasonable requirements.

Real time and detail breach notification rules: Under the GDPR, organizations are required to have a strong breach notification system in place and understand their specific reporting obligations. And cloudHQ already have these rules in place.

Accountability: cloudHQ has a clear internal privacy governance structure with necessary accountability.

YouTube API usage by cloudHQ

YouTube Terms of Use

By using Video Email by cloudHQ and Screencast Recording for Gmail by cloudHQ to upload your videos to YouTube, you agree to be bound by the the YouTube Terms of Service. Please make sure to review the YouTube Terms of Service before uploading your videos to YouTube. When uploading videos to YouTube you will be notified that cloudHQ uses YouTube API Services and you are bound to the the YouTube Terms of Service

YouTube Data Access and Revocation

In addition to our normal procedure for deleting stored data, you have the ability to revoke cloudHQ's access to your YouTube data at any time. To do so, please visit the Google security settings page and manage the permissions granted by our application.

Disclosure Of Data

Disclosure for Law Enforcement

Under certain circumstances, cloudHQ LLC may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Data Storage

cloudHQ is sync and replication service so no data is persistently stored on cloudHQ servers. To provide you with the cloudHQ Services, we may replicatie your data using servers around the world - including those outside your country. Please contact us if your data must be transferred using only servers located in certain country.

Data Retention

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, you may delete your account. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your information quickly upon request. Please note, however, that there might be latency in deleting information from our servers and backed-up versions might exist after deletion.

"Do Not Track" Signals

We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Your Rights

cloudHQ LLC aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

Whenever made possible, you can update your Personal Data directly within your account settings section. If you are unable to change your Personal Data, please contact us to make the required changes.

If you wish to be informed what Personal Data we hold about you please contact us.

Your Personal Data will be deleted upon deletion of your cloudHQ account. Please note, however, that there might be latency in deleting information from our servers and backed-up versions might exist after deletion.

In certain circumstances, you have the right:

  • To access and receive a copy of the Personal Data we hold about you
  • To rectify any Personal Data held about you that is inaccurate
  • To request the deletion of Personal Data held about you

You have the right to data portability for the information you provide to cloudHQ LLC. You can request to obtain a copy of your Personal Data in a commonly used electronic format so that you can manage and move it.

Please note that we may ask you to verify your identity before responding to such requests.

Service Providers

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

What is the GDPR?

The GDPR is a European Union regulation that establishes a new framework for handling and protecting the personal data of EU-based residents. It comes into effect on May 25, 2018.

Personal data plays a huge part in society and the economy. It is essential that people have—and know they have—control and clarity over how their data is used and protected by any organization they interact with, and that organizations are given clear guidelines to protect their personal data.

One of the aims of the GDPR is to harmonize and bring data privacy laws across Europe up to speed with the rapid technological change in the past two decades. It builds upon the current legal framework in the European Union, including the EU Data Protection Directive in existence since 1995.

GDPR: How does cloudHQ comply with the GDPR?

The GDPR is consistent with how we think and operate. Our security and privacy policy was already much stronger then any GDPR requirements.

cloudHQ already meet the requirements of the GDPR. GDPR places an increased focus on documenting decisions and practices affecting personal data: and we consider protecting and locking your personal data very importat. No personal data will even be used, moved, or transferred outside very strict requirements to provide the Service.

However you should also be working to assess your readiness for the GDPR well in advance of 25 May 2018 which is GDPR enforcement day.

Our business customer agreements incorporate the EU model contract clauses and we are certified under the EU-U.S. Privacy Shield Framework. This means there are additional legal protections and external monitoring regarding the collection, use, and retention of personal data transferred from the European Union to the United States.

Children's Privacy

Our Service does not address anyone under the age of 13 ("Children").

We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Changes to our Privacy Policy

This Privacy Policy may change from time to time. If we make a change to this privacy policy that we believe materially reduces your rights, we will provide you with notice (for example, by email). Model Contract Clauses for Business Users

In addition to providing full GDPR compliances, cloudHQ offers a data-processing amendment and model contract clauses as an additional means of meeting the adequacy and security requirements of the European Parliament and Council of the European Union Data Protection Directive. This agreement can be accepted and reviewed after purchasing cloudHQ Business Plan on your account page. To review and accept this amendment, you must be signed as admin of cloudHQ domain.
